Existing law generally provides for the confidentiality of juvenile court records and records relating to the administration of public social services. However, records connected to public social services programs are generally permitted to be disclosed for purposes related to the administration of those programs and for other prescribed purposes. This bill would recast these provisions to provide that activities of multidisciplinary personnel teams engaged in the prevention, identification, management, or treatment of child abuse or neglect, or the prevention, identification, management, or treatment of the abuse of an elder or dependent person, are activities performed in the administration of public social services. Existing law provides for the licensing and regulation of psychologists, professional clinical counselors, clinical social workers, and marriage and family therapists. Existing law requires a person applying for licensure in these professions to have completed specified coursework or training in child abuse assessment and reporting from certain types of institutions. This bill would encourage the Board of Psychology and the Board of Behavioral Sciences to include in that training elder and dependent adult abuse assessment and reporting, and would also apply that training and coursework requirement to professional clinical counselors. Existing law provides for the award of attorney's fees and costs, and damages to a plaintiff when it is proven by a preponderance of the evidence that the defendant is liable for financial abuse of an elder or dependent adult. Existing law authorizes the remedy of attachment against a defendant's property to secure the amount of the claimed indebtedness to the plaintiff in connection with cases involving financial abuse of an elder or dependent adult. This bill would require the court to issue an earnings withholding order for elder or dependent adult financial abuse, as defined, for a defendant who has been found liable for financial abuse of an elder or dependent adult, as specified. This bill would provide that a lender, broker, person, or entity that recommends the purchase of a reverse mortgage in anticipation of financial gain owes the prospective borrower a duty of honesty, good faith, and fair dealing. This bill would require that the counselor and the prospective borrower sign the checklist and return it to the lender. The bill would prohibit approval of the loan application until the signed checklist is provided to the lender.  Support

Personal income taxes: capital gains: sale of principal residence: senior citizens. The Personal Income Tax Law provides, in modified conformity to federal income tax laws, for the manner in which taxable gains are to be recognized upon the disposition of property, including real property that is the principal residence of the taxpayer. This bill would, for taxable years beginning on or after January 1, 2010, provide that gross income does not include any gain from the sale or exchange of the principal residence of a taxpayer who is 65 years of age or older. This bill would appropriate the sum of $1,600,000 from the State Health Facilities Citation Penalties Account to the department to fund local ombudsman programs in accordance with the distribution schedule during the 2010-11 fiscal year. Long-term care: assessment and planning. his bill would require the State Department of Health Care Services to initiate a process to develop, by no later than July 1, 2012, a tool for the uniform long-term care services assessment of individuals in order to assist consumers in finding long-term care services of their choice, as specified. The bill would, commencing July 1, 2012, require, with certain exceptions, every long-term health care facility that receives an application for admission of a Medi-Cal eligible or Medicare/Medi-Cal eligible person to initiate the assessment prior to admission or on the first day for which Medi-Cal reimbursement is requested.  Watch

Existing law authorizes the Emergency Medical Services Authority to establish minimum training and other standards for the use of automatic external defibrillators (AED) and requires persons or entities that acquire the AEDs to comply with maintenance, testing, and training requirements, which are scheduled to change on January 1, 2013. Existing law sets forth tenant notice and other requirements for building owners in which an AED is placed. This bill would repeal those provisions. Existing law, the California Child Day Care Facilities Act, subjects each licensed child day care center to unannounced visits by the State Department of Social Services and requires the department to visit these facilities as often as necessary to ensure the quality of care provided. The act also requires the department to conduct an annual unannounced visit to a licensed child day care center under specified circumstances, and no less often than once every five years. This bill would require the department to make annual unannounced visits of all licensed child day care centers.   Watch

Existing law specifies the procedures for a licensee of a long-term health care facility, which includes a skilled nursing facility and intermediate care facility, to contest a citation or the proposed assessment of a civil penalty by the State Department of Public Health, which includes the option to adjudicate the validity of the citation in the superior court in the county in which the facility is located. This bill would declare the intent of the Legislature to enact legislation that would assign responsibility for federal informal dispute resolutions and state citation review conferences to an independent 3rd party outside of the State Department of Public Health, as specified.   Watch
